Algemene voorwaarden en Privacy policy

Naast onze producten willen we ook de beste service bieden. We willen onze passie met jullie delen en we streven ernaar jullie daarbij de allerbeste service te bieden. 

Dat is wat ons bedrijf voor staat en daar zijn we trots op. 

Onze algemene voorwaarden en de privacy regels kan u hieronder terugvinden. Eveneens als ons retourbeleid. 
Om deze voor iedereen toegankelijk te maken zijn ze in de universele Engelse taal opgemaakt. Aarzel niet om ons te contacteren bij vragen of indien u de Engelse taal niet/ onvoldoende machtig bent.

General Conditions - Algemene voorwaarden 

1. DEFINITIONS:

These General Terms and Conditions apply to:
- the Company: Estilo de Vida, trading under the name "www.estilodevidainterior.com".
- the Customer: the person buying a product from the Company. 

 
2. GENERAL TERMS AND CONDITIONS: 

The General Terms and Conditions apply to every transaction between the Company and the Customer as well as to the application of the contract.  

The Company reserves the right to alter the present Terms and Conditions at any time without prior notice. 
The contract is governed by the version of the Terms and Conditions applicable on the date on which the purchase is made.


3. THE CONTRACT: 

The contract is applicable the moment the Customer has paid for the order and the Company has confirmed the order by email. The Customer may terminate the contract as long as the receipt of order has not yet been confirmed by the Company.


4. PRODUCT: 

The prices of the products are net, given in euros, incl. VAT.


5. PAYMENT: 

All orders must be paid for using the payment facilities mentionned on this site.  


6. DISPUTES: 

All potential disputes concerning the contract of sale will come under the exclusive jurisdiction of the courts of the district of Antwerp, and are subject to Belgian Law.   

Disputes between the consumer and the trader with regard to the establishment or execution of contracts in relation to products and services consumer or the trader.

A dispute shall only be handled by the Dispute Committee when the consumer has submitted a claim to the trader within a reasonable timeframe.

The trader shall be bound by the consumer’s decision to submit a dispute to BeCommerce.
When a dispute is submitted by the trader, the consumer must respond to the trader’s written request within five weeks to indicate that he/she agrees to submit the dispute to BeCommerce, or to state that he/she prefers to submit the dispute to a court having jurisdiction.

If the trader has not been notified of the consumer’s decision within five weeks, the trader is entitled to submit the dispute to a court having jurisdiction.

Rulings from BeCommerce shall be made in accordance with the conditions defined in the rules of procedure. Decisions handed down by the Dispute Committee are binding opinions.

The Dispute Committee shall not handle a dispute, or shall cease processing a dispute, if the trader has been granted a suspension of payment, or if the trader is bankrupt, or if the trader has effectively ceased trading, before a dispute was processed during a Committee session and a final ruling was handed down.

 
7. CANCELLATION

The client has the right to rescind their purchase, without penalty, no questions asked, by notifying the company within fourteen (7) calendar days starting from the date of delivery of the item.

To cancel an order, the client must provide written notification to the company before the end of the seven-day cancellation period. The client can do this by mailing a declaration that clearly states the client's decision to cancel the order to shop@estilodevidainterior.com

The item(s) may only be returned after providing notification to the company about order cancellation. Please note the following points:

  • return shipping charges are always at the client's expense.

Items must be returned to the following address: Estilo de Vida interior - Harmonielaan 2 2960 Brecht - Belgium.
Returns are strictly at the client's risk. The company is not liable for any returned items that are lost or damaged.

  • returned items must be complete including any accessoiries, etc...
  • the item must be returned in its original packaging.
  • the returned item must not have been used.
  • items that are returned in a dirty state will not be accepted.
  • personalized and made to order items may not be returned.
If the above conditions are not met, the company reserves the right to refuse to refund the returned items.

8. REFUND POLICY FOR RETURNS:

  • the refund (excluding the initial delivery fees) will be carried out within 14 days of receipt of the cancellation. 
  • the refund has to be applied by mail to 'shop@estilodevidainterior.com' with the number of items and the reason for return. The return has to be adressed to our compay  within 14 days after receval of the  original order. If later than 14 days the compay has all richts te refuse the return. 
  • returnadress: Harmonielaan 2, 2960 Brecht
  • in the event of a partial return, make sure you pack all item secure and safe.
  • sale or discount-items are not refunded. You will receive a voucher for the payed amount that will be valid for 2 years on our webshop.

 
9. COMPLAINTS: 

All complaints for whatever reason, can only be made after replacement of a delivered item, or where replacement is not possible, upon maximum refund of the purchase price. 

If an item is damaged, the Customer must submit a complaint in through mail within 14 days. If this is not done, the Customer will forfeit his right to complain.  

Upon delivery of the goods, the Customer must check that the delivery corresponds to the items ordered.
All claims must be submitted in writing within 14 days of delivery.
The trader shall respond to a claim within 14 days of receipt.

If, due to unexpected circumstances, more time is needed to process a claim, the trader shall still respond within 14 days, to inform the client that the claim has been taken into account, and to indicate when the client can expect to receive a more detailed response.

If the claim cannot be resolved by mutual agreement, it can then be considered a dispute which may be submitted to the Dispute Committee.

 
10. INTELLECTUAL PROPERTY:

The entire content of the website "www.estilodevidainterior.com", including the images, text, brands,.... is the sole property of Estilo de Vida and the nemad brands. Pictures are copywright from the brands Bazar Bizar, Hippie Monkey and Imbarro, Bombyxx, PTMD, Light and Living, Pole to Pole and all other brands named on our website.

Written permission from Estilo de Vida or the brand zhere the picture is from is required for reproduction of any content, whether full or partial, by whatever means.

Failure to obtain such permission will incur the risk of prosecution.

 
11. MINIMUN AGE REQUIRED FOR PURCHASE: 

To make a purchase, the Customer must be 18 years or over, or have the permission of a parent or guardian.  

 
12. LEGAL COMPLIANCE:

The trader guarantees that the products and/or services comply with the contract, the specifications stated in the offer, reasonable quality and/or usability requirements, and the statutory stipulations and/or government regulations that existed at the time the contract was concluded.

A warranty arrangement offered by the trader, manufacturer or importer shall in no way affect the rights and claims that a consumer is entitled to in the event that the trader fails to fulfil its obligations, on account of the trader, in accordance with legal provisions and/or the distance contract.
